2. About This Policy
This Privacy Policy describes how Pro Lien LLC (“ProLien,” “we,” “us,” or “our”) collects, uses, shares, retains, and protects information in connection with our municipal lien-search services and our customer-facing portal at app.prolien.com (collectively, the “Services”).
ProLien is a business-to-business (B2B) service. Our customers are title companies, title agents, real-estate closing attorneys, mortgage lenders, and their authorized employees. The Services are not directed to individual consumers or to children, and we do not solicit information directly from members of the general public.
This Policy applies to information processed through the Services. It does not apply to information customers process under their own privacy policies, to information available through public records as published by the originating government agency, or to third-party websites linked from the Services.
3. Who We Are
ProLien provides research reports for United States real-estate transactions. We are not a consumer reporting agency, and we do not provide “consumer reports” under the federal Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.). Our reports are intended for use by professional real-estate participants in connection with closing due diligence; they are not used to establish a consumer’s eligibility for credit, insurance, employment, or other FCRA-covered purposes.

4. Information We Collect
The categories we collect, the purposes, sources, and retention periods are summarized below and described in Sections 4.1 through 4.4.
4.1 Information you provide When a customer establishes an account, places an order, communicates with support, or otherwise interacts with us, we collect the information the customer or its authorized user submits. This includes the account, order, payment, and support information described above, and is used as described in Section 5.
4.2 Information you provide about third parties
Many orders include personal information about individuals who are not our customers — most commonly, the names of sellers and buyers in a real-estate transaction submitted on a closing file. We refer to this information as “Third-Party Order Information.”
ProLien processes Third-Party Order Information on behalf of, and at the direction of, the customer that submitted the order. That customer is responsible under its own privacy policy and applicable law for the Third-Party Order Information it provides to us, including any notices to or consents from the relevant individuals. ProLien does not use Third-Party Order Information to market to those individuals, does not sell or share it for cross-context behavioral advertising, and does not enrich or combine it with information from outside the order for purposes unrelated to producing the requested report.
If a third-party subject (for example, a seller or buyer) contacts ProLien about Third-Party Order Information, we will, where reasonable, refer the individual back to the customer that initiated the order. Where required by law to respond directly, we will do so and will reasonably assist the customer in responding.
4.3 Information collected automatically
When an authorized user accesses the Services, we and our service providers automatically collect technical information such as IP address, browser and device type, operating system, referring URL, pages viewed, timestamps, session identifiers, cookies, and audit-log events. We use this information to operate, secure, monitor, and improve the Services. See Section 6 for cookies.
4.4 Information from public records
To prepare a research report, we collect information from county and municipal public-records sources, tax collectors, utility providers, the U.S. Census Geocoder API, and equivalent public sources. Public-records information is provided to us as it appears in the originating source. ProLien is not the publisher of that information, and changes to records published by a government agency must be made with that agency.
5. How We Use Information
We use the information in Section 4 to:
• Provide, administer, deliver, and improve the Services, including producing and delivering lien-search reports;
• Authenticate users, secure the portal, prevent fraud and abuse, and investigate security incidents;
• Bill for the Services, process payments, and resolve invoicing disputes;
• Communicate with customers about orders, support, account administration, service announcements, and material changes to this Policy;
• Maintain audit logs and transaction records for compliance, defense of legal claims, and response to subpoenas, regulatory inquiries, and customer audits;
• Develop, test, and improve internal tooling and quality-assurance processes, including the human-in-the-loop review process described in Section 7.2; and
• Comply with our legal and regulatory obligations and enforce our agreements.
6. Cookies and Analytics
We and our service providers use cookies, pixels, local storage, and similar technologies (collectively, “cookies”) on our public marketing site and within the portal. Cookies fall into the following categories:
• Strictly necessary cookies — required to deliver the Services, including authentication, session management, load balancing, and security.
• Performance and analytics cookies — help us understand how the Services are used so we can improve performance, reliability, and usability.
• Functionality cookies — remember preferences, such as language or session display settings. ProLien does not use cookies to deliver cross-context behavioral advertising and does not sell information collected through cookies.
We honor opt-out preference signals sent through the Global Privacy Control (GPC) where they are applicable to the Services. Most browsers also allow users to manage or block cookies through their browser settings. We do not currently respond to legacy “Do Not Track” (DNT) signals in a separate manner.
7. How We Share Information
We share information only as described in this Section 7. We do not sell personal information or share it for cross-context behavioral advertising, and we do not authorize service providers to do so on our behalf.
7.1 Service providers and sub-processors
We share information with vendors that perform services on our behalf, under written agreements limiting their use of the information to providing services to ProLien.
7.2 Legal, protective, and corporate-transaction disclosures
We may disclose information when we believe in good faith that disclosure is necessary to: (i) comply with a law, subpoena, court order, or other legal process; (ii) respond to a lawful request by a public authority; (iii) enforce our customer agreements or this Policy; (iv) protect the rights, property, or safety of ProLien, our customers, or others; or (v) detect, investigate, prevent, or respond to fraud, abuse, or security incidents. We may also disclose information in connection with a merger, acquisition, financing, reorganization, or sale of assets, subject to customary confidentiality protections.
8. International Data Transfers
ProLien is established in the United States and processes personal information in the United States. Where ProLien transfers personal information to or makes it accessible from a jurisdiction outside the United States, that transfer is supported by written confidentiality and data-protection obligations and the technical and organizational measures. Personal information processed under this Policy continues to be governed by United States law and by this Policy.
By submitting an order or otherwise using the Services, the customer acknowledges and (where required) consents, on its own behalf and on behalf of individuals whose information appears in Third-Party Order Information, that such information may be transferred to and accessed.
9. Data Retention
We retain personal information for as long as we need it to provide the Services, comply with legal and contractual obligations, resolve disputes, and enforce our agreements. Our standard retention period for order records, delivered reports, and public-records information is two (2) years from the closing date associated with the order, or longer as required by law, litigation hold, regulatory request, audit, or active customer relationship.
Information subject to a legal hold or audit is retained for the duration of that hold or audit and then returned to the standard schedule. Tokenized payment information is retained as long as the payment relationship exists and for a period thereafter consistent with tax and chargeback obligations. Where information no longer has a retention purpose, we delete it, anonymize it, or place it beyond use, subject to backup-rotation cycles.
10. Data Security
We maintain physical, technical, and organizational measures that are designed to protect personal information against unauthorized access, disclosure, alteration, and loss. These measures include encryption in transit and at rest for personal information in our production environment, role-based access controls, multi-factor authentication for administrative access, logging and audit trails, vendor due diligence, written confidentiality obligations on personnel and sub-processors, periodic access reviews, and security training for personnel with access to personal information.
No method of internet transmission or electronic storage is completely secure, and we cannot guarantee absolute security. If we become aware of a security incident triggering a notification obligation under the Florida Information Protection Act (Fla. Stat. § 501.171) or other applicable law, we will provide notice as that law requires.
11. Your Privacy Choices
Customers and authorized users have the following choices:
• Account information. Authorized users may review and update account information within the portal or by contacting their account administrator.
• Marketing communications. Recipients may opt out of marketing emails by following the unsubscribe link in any such email. Transactional and service messages (for example, order status or invoice notifications) will continue.
• Cookies. Cookie preferences may be managed through the cookie controls on our site (where offered) and through browser settings. We honor the Global Privacy Control where applicable to the Services.
• Privacy requests. Privacy requests may be submitted to support@prolien.com. We may need to verify the requestor’s identity (and, where the request is made by an authorized agent, the agent’s authority) before acting on a request. 12. Florida Resident Rights ProLien is currently below the revenue threshold for “controller” obligations under the Florida Digital Bill of Rights (Fla. Stat. §§ 501.701–501.722). Even so, we voluntarily extend the following rights to Florida residents whose personal information we hold:
• Right to confirm and access the categories of personal information we hold about you and obtain a copy in a readily usable format.
• Right to correct inaccuracies in the personal information we hold about you, taking into account the nature of the information and the purpose of processing.
• Right to delete personal information we hold about you, subject to exceptions for information we are required or permitted to retain, including for completed transactions, fraud prevention, security, defense of legal claims, and compliance with law.
• Right to opt out of (a) the sale of personal information, (b) targeted advertising, and (c) profiling in furtherance of solely-automated decisions producing legal or similarly significant effects. ProLien does not engage in any of these activities; this confirmation is provided for transparency.
• Right to appeal a denial of a privacy request. An appeal may be submitted to privacy@prolien.com within forty-five (45) days of the denial. We will respond to the appeal within forty-five (45) days. If the appeal is denied, you may contact the Florida Department of Legal Affairs. To submit a request, email support@prolien.com with enough detail for us to identify the information at issue. We will verify identity as appropriate and respond within forty-five (45) days, subject to one 45-day extension where reasonably necessary. Where the request concerns Third-Party Order Information, we will, where reasonable, refer the individual to the customer that submitted the order.
12. Residents of Other States
Based on current operations and revenue, we do not believe ProLien is subject to the comprehensive consumer-privacy laws of California, Virginia, Colorado, Connecticut, Utah, or any other state. For transparency and consistency, we voluntarily extend the rights in Section 12 to residents of all U.S. states whose personal information we hold. Where state law provides additional rights and we are subject to that law, we will honor those rights as required.
13. Children’s Privacy
ProLien is a business-to-business service. The Services are not directed to children, and we do not knowingly collect personal information from individuals under eighteen (18). If we learn we have collected such information, we will delete it. If you believe a child has provided personal information to us, please contact support@prolien.com.
14. Third-Party Links
The Services may include links to third-party websites, including those of counties, municipalities, tax collectors, and utility providers from which we obtain public-records information. Those websites are not operated by ProLien, and this Policy does not apply to them. Review the privacy policies of any third-party website you visit.
15. Changes to This Policy
We may update this Policy from time to time. The “Effective Date” at the top of the Policy will indicate when it was last updated. Where a change is material, we will provide notice to the account contact on file or through the portal before the change becomes effective. Prior versions of this Policy are available on request to support@prolien.com.
